TACPA Preference Under the TACPA, preferences are available where contracted services are to be performed at worksites designated by the State as distressed areas. Under this MSA, the ultimate worksites are presently unknown because services will be performed at future disaster locations. Please confirm whether DGS will apply a TACPA preference to Proposers under this RFP.

Customer Reference Attribution – Subcontractor/JV Experience We believe there is an ambiguity in the “Customer References” section of the RFP and Attachment 5 – Customer Reference Form as these provisions pertain to experience obtained under Assessment & Monitoring (A&M) subcontracts or as members of joint ventures. The RFP does not distinguish between the “agreement dollar value” of a subcontract and that of the underlying prime contract. Nor does it distinguish the scope of work performed by individual members of a joint venture. For example, a subcontractor may have performed post-disaster A&M services on 40 APNs where the prime A&M contract covered 10,000 APNs and exceeded the Category 3 threshold of more than $55 million. A literal reading could allow the subcontractor to rely on the entire prime contract value and APN count even though its A&M responsibility was substantially more limited. (a) Will the State clarify RFP Section 3.2.2(1) to state that, for references related to A&M work performed as a subcontractor, the Proposer should report the agreement dollar value of the subcontract and the number of APNs for which the Proposer performed A&M services? (b) Likewise, will the State clarify that, for references related to A&M work performed as a member of a joint venture, the Proposer should report the agreement dollar value and APNs attributable to the portion of the work performed by the Proposer? (c) Will the State similarly clarify Attachment 5, Sections 1(b) and 1(c), regarding the agreement value and APNs to be reported for subcontractor and joint venture experience?

Independent Competition and Shared Resources Across Teams Under Q&A 88, RFO proposers must disclose to the User Agency when an entity or individual is participating in multiple responses to an RFO. Allowing such shared resources across teams competing under the same RFO raises concerns regarding competitive integrity. These concerns include conflicts of interest, collusive bidding, and nominal competitors sharing competitively sensitive information such as technical approaches to RFO requirements. Will the State reconsider allowing shared resources across teams responding to the same RFO? If not, will the State require User Agencies to take specific steps to mitigate the risks to competitive integrity arising from shared resources across competing teams?

Cal eProcure does not list the prime consultants for this solicitation, and we would like to conduct outreach accordingly. Would you happen to have a list of the primes that we could reference?

Regarding RFP 5269942, Addendum 2 provides several material clarifications and revisions that may affect Proposers’ technical responses, customer references, subcontracting arrangements, pricing, and overall proposal strategy. Proposers may also submit follow-up questions regarding certain Addendum 2 responses that require additional clarification before proposals can be finalized. Given that the proposal due date has not been extended following issuance of Addendum 2, will DGS consider extending the proposal submission deadline to provide Proposers with a reasonable period to fully review and incorporate these changes into compliant proposals?
Deadline
▶
Because Addendum 2 materially changed the qualification requirements and proposers must obtain two fully completed reference forms from end-user agencies before submission, will DGS extend the proposal deadline by at least 30 calendar days?
