WHAT THEY WANT
The Oregon Department of Human Services (ODHS) and the Oregon Health Authority (OHA), acting jointly through their respective equity and multicultural services offices, are seeking multiple qualified contractors to provide on-demand and pre-scheduled telephonic interpreter services for Limited English Proficient (LEP) individuals accessing state health and human services programs across Oregon. This cooperative procurement replaces contracts that expire September 30, 2026, and will serve over one million Oregonians annually who interact with ODHS and OHA programs, contracted partners, and community-based service locations.

Given the anticipated five-year initial term and potential extensions up to a cumulative ten years, please clarify whether Contractors may request periodic rate adjustments based on CPI, COLA, changes in market conditions, or documented increases in interpreter labor costs, or whether rate changes may only be initiated at ODHS/OHA's discretion.

As the Agencies anticipate awarding multiple Contracts and do not guarantee any volume of services, please clarify how work will generally be allocated among awarded Contractors, including whether the Agencies anticipate a primary/secondary vendor hierarchy, rotation, lowest-rate-first methodology, or another ordering methodology.

Background Checks regarding the 30-Day Break Requirement in Attachment F “Sample Contract,” Exhibit A, Part 3, section 4(b)(2). For independent-contractor interpreters who remain active in the Contractor's interpreter network but may not receive an ODHS/OHA assignment for more than 30 days, does that period constitute a "break in subcontracting" requiring a new background check, or does the 30-day provision apply only when the contractual relationship with the interpreter has actually ended?

The RFA states that the terms and conditions contained in Exhibit A Part 3, Exhibit B, Exhibit C, and Exhibit D may not be negotiated “unless required by circumstance.” Please clarify what is meant by “unless required by circumstance.” Related Question: If an Applicant does identify a term or condition in these Exhibits that it cannot comply with or accept as written, is there a process for requesting an exception or modification, and if so, when and how should the Applicant submit such a request?

Section 4.1 states that exceptions may be considered for providers of Languages of Lesser Diffusion. Please clarify which minimum requirements may be modified or waived for an LLD-focused applicant, including the requirement for three years of 24/7/365 telephonic interpretation experience with state or local government entities.
